  1. Data Controller. The personal data that you provide to us or that EUROPASTRY accesses as a result of your browsing, queries and/or requests through this website will be processed by EUROPASTRY, S.A. as the data controller. EUROPASTRY, S.A. has appointed a data protection officer whom you can contact at delegadoprotecciondatos@europastry.com.

  2. Legitimation. In general terms, we base the processing of your data on your consent. If you are a customer (professional or consumer) or supplier, we base the processing on the execution of the contract between us. Your acceptance to be sent commercial information can always be revoked, although not retrospectively, and for this you need to notify us by email at contact@europastry.com. In any case, in each communication you will be offered the chance to object to the sending of commercial communications. EUROPASTRY may carry out certain data processing based on its legitimate interest (e.g. analytics).

  3. Category of data. EUROPASTRY processes the following categories of data: Identification data such as name and surname. Contact details: telephone, email address and postal addresses. Some of the personal data requested in the form are mandatory. A refusal to provide them will mean that we cannot complete and/or respond to your request. In the event that the user provides data from third parties, they declare that they have obtained their consent and undertake to make them aware of the information contained in this clause, releasing EUROPASTRY from any liability in this regard. However, EUROPASTRY may carry out checks to verify this fact, taking the corresponding due diligence measures in accordance with data protection regulations. EUROPASTRY reserves the right to carry out, at any time, as many corporate checks and verifications as are necessary to guarantee the accuracy of the data provided, thereby avoiding possible duplications and/or errors in the information provided by the user, in this way guaranteeing the requested service and providing greater legal security to both parties.

  4. Purpose. EUROPASTRY will process user data manually and/or automatically for the following purposes: Contact form: we will process your data in order to manage your information requests. Prepare anonymous statistical reports regarding access habits and the activity carried out by users on the Platform. Comply with legally-established obligations, as well as verify compliance with contractual obligations, including fraud prevention. Periodically send (the channels we usually use are email, post, telephone, SMS, Push message) electronic communications with offers, promotions and news related to our products unless otherwise indicated or the user objects or revokes their consent. The personal data provided, in general, will not be communicated or transferred to third parties, although they could be transferred to other companies in the EUROPASTRY Group for the purposes referred to above if the query is directed to another company in the group or to another brand. In the event that personal data is communicated or transferred to other third parties or other group companies, EUROPASTRY will obtain the user’s consent beforehand, in accordance with the requirements provided for in the current legislation, which may be revoked at any time. Likewise, EUROPASTRY will be obliged to communicate data to the Public Authorities for compliance with its legal obligations. EUROPASTRY works with suppliers and service providers who can access personal data. We have ensured that they all comply with current regulations and offer adequate guarantees in accordance with them, even if they are outside the European Union.

  6. Retention of personal data. We will retain your data for as long as necessary to fulfil your request and in any case, no longer than the time strictly necessary to fulfil the legal, tax or administrative obligations with which the company must comply.

  7. Data security. EUROPASTRY has implemented the necessary technical and organisational security measures that guarantee the security of the user’s personal data and prevent its alteration, loss, treatment and/or unauthorised access, taking into account the state of technology, the nature of the stored data and the risks to which they are exposed, whether they come from human actions or the physical or natural environment, all in accordance with the provisions of the current regulations.

  8. Exercising of the user’s rights and contact with the Data Protection Officer. The user must complete the fields marked as “required” in the Platform’s contact forms. A failure to complete or a partial completion of the required personal data could mean that EUROPASTRY will not be able to respond to your request and, consequently, EUROPASTRY will be released from all liability. The user will be liable in any case for the truthfulness of the data provided and EUROPASTRY reserves the right to exclude from the Platform and the services requested any user who has provided false and/or incorrect data, without prejudice to other legally-appropriate actions. In the event that consent is the basis that legitimises the processing of the data, the user may revoke their consent at any time without this affecting the previous processing. The user may at any time exercise their rights of access, rectification, deletion and objection to the processing of personal data, as well as the rights of portability and restriction, and contact the Data Protection Officer at EUROPASTRY’s registered office under the terms established in the current legislation or by sending an email to delegadoprotecciondatos@europastry.com. Lastly, pursuant to the provisions of the GDPR, we inform you of your right to file a claim with the Spanish Data Protection Agency www.agpd.es in the event that you consider that we have not adequately guaranteed your rights.
